5. Orders & Payments
5.1 Placing Orders
All orders must be confirmed in writing via email or signed purchase order. The details, including product specifications, quantities, prices, and delivery timelines, will be finalized before work begins.
5.2 Pricing
Prices are provided in our quotations and are valid only for the period specified.
Taxes, duties, and delivery charges may apply based on the order and location.
5.3 Payments
Payment terms will be specified in your quotation or invoice.
We may require an advance payment before starting production.
Late payments may incur interest charges as per applicable law.
6. Delivery & Risk
We will make every effort to deliver products on time; however, delays due to unforeseen events (force majeure) will not make us liable for penalties.
The risk and ownership of goods transfer to you upon delivery to the agreed location.
You must inspect the goods upon delivery and report any issues within 48 hours.
7. Quality Assurance
MK Industries follows strict in-house quality control measures:
All products are tested before dispatch.
Quality certificates can be provided on request.
Any issues arising from defects in materials or workmanship must be reported within the warranty period.
8. Warranties & Limitations
We warrant that our products will meet agreed specifications and be free from manufacturing defects for the period mentioned in the quotation.
This warranty does not cover damage caused by misuse, improper storage, unauthorized modifications, or normal wear and tear.
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages.
9. Intellectual Property
All designs, drawings, specifications, and technical documents created by MK Industries remain our intellectual property unless otherwise agreed in writing.
You may not copy, distribute, or reproduce our materials without prior permission.
10. Confidentiality
Both parties agree to keep all business, technical, and financial information exchanged during the course of our relationship confidential and not disclose it to any third party without written consent.
11. Returns & Cancellations
Due to the custom nature of our products, returns are generally not accepted unless there is a confirmed defect.
Cancellations must be made in writing. If production has already started, cancellation charges may apply.
12. Compliance with Laws
You agree to use our products in compliance with all applicable local, state, and international laws and regulations.
13. Limitation of Liability
To the maximum extent permitted by law:
MK Industries’ total liability for any claim will not exceed the total amount paid for the specific order.
We are not responsible for losses due to delays, operational downtime, or indirect business losses.
14. Force Majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, war, government restrictions, or supply chain disruptions.
15. Indemnification
You agree to indemnify and hold harmless MK Industries, its employees, and affiliates from any claims, damages, or expenses arising out of:
Your misuse of our products.
Violation of these Terms.
Violation of applicable laws.
16. Amendments
We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on our official website or communication through email.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Bhopal, Madhya Pradesh.
